Turbovac, (I think the company has something to do with parking lots), filed a mechanic's lien against Bersin Properties on January 11th, 2012. Congel owes them $38,343.00.
Rochester Business Journal listed it in "The Record" section of their online news site on February 10th, 2012. Medley P.I.L.O.T. Payment
According to City News, Congel has made his PILOT payment on time. Yay.

Here's An Opinion
It's a guest essay in the opinion section of the online D&C website.
There are a couple of facts in there.
Like, the quote from the Supervisor about Congel doing something.....ANYthing...at Medley.
"It should get going this year if all the stars align. It will be fabulous for Irondequoit"
I think the planets are aligning with the center of the galaxy this year....I don't know about stars....but I'm not so confident that he'll do something before we all die on December 21st, 2012!
The other fact is this quote from the Supervisor about getting a lot of comments about the libraries.
" she gets an awful lot of pressure from residents to consolidate Irondequoit's library branches."
The writer asks that she substantiate these requests.

Ads & Letters In I-Post
Here are some items that were in the Irondequoit Post pertaining to the upcoming elections. The letters section had a very good letter from Ginny Maier.
Here's the text of Ginny's excellent letter:
Were developer’s interests put before town’s I was a resident of Irondequoit when the latest Medley Center agreement was signed. Stephanie Aldersley and John Perticone were on the Town Board at that time. They signed off on a change to the town zoning law written just for this developer, which gave him the right to make changes to the project without any further public review, a privilege that no other property owner has. They agreed to a property tax break that Aldersley herself (at a Town Board meeting on March 2009) estimated as worth $40 million. When the 84-page text of the PILOT was released to the public, we were given less than three business days to review the agreement before the Town Board voted on it.
Stephanie Aldersley and John Perticone refused repeated requests from residents for more time to understand the size, the length and the details of the tax benefit provided before their vote.
John Perticone never responded to repeated emails from residents expressing concerns about the agreement. But at a Town Board meeting in February 2009, he made a point of thanking the developer, saying “it’s been a nice process.”
Stephanie Aldersley and John Perticone have remained on the Town Board while the developer of Medley has repeatedly ignored or missed deadlines that were built into the agreement to, supposedly, protect the town and its taxpayers. They have done nothing to require that the developer be held accountable to the agreement they signed.
Stephanie Aldersley and John Perticone have repeatedly failed to act in the best interest of the people they represent in the most consequential matter to come before the Town Board in their terms of office.

Tonight's TBM - Action On Medley?
According to the agenda on the Town's website, the last item on the agenda says:

What Bill?
Do you remember the June 21st Town Board Meeting where Marasco asked the board to pass a resolution requiring that Congel pay $750,000 the town believes it is owed based on the PILOT agreement — or risk termination of the PILOT? His motion for a resolution died for lack of a second.....because....."the town board is getting tough with the Medley Developer" - what a joke that headline was.
Anyways, MJD said during the meeting that "there's a current bill in the State Legislature's ways and means committee in Albany that could have an impact on the project."
What bill would that be? I've searched the archives of bills - and I checked out the updates on the NYS Assembly Ways And Means and I found nothing that resembles a bill that could have an impact on Medley Centre.

Medley Sued Again

This time it's Vigilant Insurance Co. suing Bersin Properties for $18,277.00 - and they haven't seen a penny yet.
I wonder if he's paid Passero or the plow guy yet?
If it wasn't for David Andreatta - Congel probably wouldn't have paid the PILOT payment and the taxes to the special districts either.

Congel Made The 3rd Installment Payment -
- This is becoming a habit! The 3rd payment installment was due March 31st (along with 3% interest), and the last installment is due April 30th.
I can no longer link to the Monroe County Tax Portal's info on Medley directly from this blog. You have to go to the portal and type in the property numbers below, and search them that way. I will put up the first property's screen shots, just to show that he paid, and directions on how to navigate the tax portal:

Oh - So THAT'S Why Congel Was Delinquent
He didn't pay the Special District taxes in 2010.

That's why the properties in the blogs I did showed him as delinquent - not from PILOT payments - it was because he didn't pay the special district taxes, and the County ponied it up for him (the districts did get their money), and the County took possession of the liens on the property.

Did He or Didn't He?
Did Congel pay COMIDA in 2010? I still don't know. I know the Town of Irondequoit and the EICSD were paid by COMIDA - but the Monroe County Real Property Tax Portal still shows his 2010 payment as delinquent, and there are new totals for 2011 that are due the end of January (I think). There are still no payments listed under "Payment History" for 2010 - all other years are listed.

Town Hall Is Historic - Not Histrionic
Ahhhhh - feels good for a change.

The beautiful, majestic Irondequoit Town Hall is now listed on the Town's historic registry - which protects that lovely building from ever being torn down, or from any future structural changes without going through the Preservation Committee first.

Did Congel Pay His Taxes?
I was told (through articles and news reports) that he paid on March 15th - but when I click on the parcel ID #'s for the property included in the P.I.L.O.T. - it says he's still delinquent.
County tax rolls are usually filed around July 1st, so if he did pay in March, I would assume that this would be reflected in the information on the tax portal website. It isn't. It says he's still delinquent.

Well.....it looks like Congel is doing a little re-arranging. To be "cost effective". That's nice. Some new designs on the plans. Great. No demolition yet. Don't know when. Maybe in a couple of years?

Congel Pays His Taxes - Morelle Wants To Give Him State Aid

"I have not spoken to the developer in several months," Morelle said, "So I think we're all rightly concerned about plans he has going forward, and I think it's time that people stepped up the pressure. And, 'look you have to make a decision soon.' Obviously it's an important project and we want it to move forward, but there won't be any State Aid and I won't be advocating for State Aid until we see a lot more activity by the developer."
You're going to give him State Aid too?!?!
